These terms govern your use of Hosterman. By creating an account or using the service, you agree to them.
1. Who we are
Hosterman is operated by Swiss Web Development Kiefer (Marvin Kiefer), Steinstrasse 60, 5406 Rütihof, Switzerland("we", "us"). These terms form an agreement between you and us.
2. The service
Hosterman lets you deploy and control workloads — game servers, apps, databases, static sites and Linux containers — that run as isolated containers on our infrastructure. The service is currently in beta: features may change, and no payment is collected during the beta. Selecting a plan records your intended configuration but does not create a charge.
3. Your account
You must provide accurate information, keep your credentials secure and are responsible for all activity under your account. You must be legally able to enter into this agreement. Notify us promptly of any unauthorised use.
4. Acceptable use
You agree not to use Hosterman to:
- break any applicable law or infringe others' rights;
- host or distribute malware, illegal content, or content that is abusive, hateful or infringing;
- send spam, run phishing, mine cryptocurrency, or launch attacks such as denial-of-service against any target;
- attempt to break isolation, gain unauthorised access, or disrupt the platform or other users;
- exceed or circumvent the resource limits of your plan, including the restrictions of the free tier.
5. Free and time-limited projects
Free-tier projects run with fixed settings and reduced resources. Some free projects are time-limited: when the timer ends the server stops, and its data is kept for one day so you can recover it by upgrading — after that the data is deleted permanently. The countdown is independent of whether the server is running.
6. Your content and backups
You retain ownership of the content and code you deploy, and you are solely responsible for it and for having the rights to use it. You are responsible for maintaining your own backups. We may remove content or suspend workloads that violate these terms or that threaten the security or stability of the platform.
7. Availability
We work to keep Hosterman available and reliable but do not guarantee uninterrupted or error-free operation, especially during the beta. We may perform maintenance, apply limits, or modify or discontinue features.
8. Suspension and termination
You may stop using the service and delete your projects or account at any time. We may suspend or terminate access if you breach these terms, create risk or legal exposure, or abuse the service. On termination, your right to use the service ends and associated data may be deleted.
9. Disclaimer and liability
The service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by law, we are not liable for indirect or consequential damages, loss of data or loss of profit. Nothing in these terms excludes liability that cannot be excluded under mandatory Swiss law (e.g. for intent or gross negligence).
10. Changes to these terms
We may update these terms as the service evolves. The date at the top shows the current version; continued use after changes take effect means you accept them.
11. Governing law and jurisdiction
These terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is the Canton of Aargau, Switzerland, subject to any mandatory consumer-protection provisions that apply to you.
